The Constitution of the
Commonwealth of Mazeria
We the People of the Commonwealth of Mazeria, in Order to form a more perfect Commonwealth, establish Justice, insure domestic Tranquility, provide for the common defence, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for Our Commonwealth of Mazeria.
Article I: The Legislative Government
1.1 All legislative authority in the Commonwealth shall be invested in a Commonwealth legislature styled as the "Congress of the Commonwealth".
1.2 The Congress of the Commonwealth, herein referred to as the Congress, shall be a bicameral legislature and consist of an Upper House, the Senate, and a Lower House, the House of Representatives.
1.3 The Senate shall consist of a minimum of three Senators elected at every general election. Senators, from amongst themselves, will elect a presiding officer to be styled as the "President of the Senate". The Senate may establish its own procedures and regulations to aid in the completion of its duties.
1.6 The Senate shall have the duties of:
(a) exercising the legislative authority of the Congress,
(b) providing consent or veto to nominations to the Presidential Cabinet,
(c) subpoena citizens to appear before hearings,
(d) providing consent or veto to foreign treaties, acts of war and acts of peace,
(e) creating Congressional Resolutions to state the position of the Congress on issues.
(f) deliberate and vote on Acts of Impeachment
1.4 The House of Representatives shall consist of citizens who apply to the Chamber. Citizens in the Chamber shall be styled as Congressmen or Congresswomen. The House of Representatives may establish its own procedures and regulations for the application and removal of members and any other necessary procedures and regulations. The House of Representatives shall be a roleplaying legislative body tasked with the establishing legislation to address issues and crises faced by the nationstates nation of 'Frederick DC'. The House of Representatives will, from amongst themselves, elect a presiding officer to be styled as the "Speaker of the House of Representatives" every 30 days.
1.5 The list of members of the House of Representatives shall be reviewed and updated 30 days after the last General Election. Members must reapply every 30 days after the last General Election, excluding the Speaker who shall preside over the reapplication of members.
1.5 No legislation shall become law unless it has received assent from the President of the Commonwealth of Mazeria. Should the President of the Commonwealth veto legislation, it shall be returned to its respective chamber. The Chamber may then have a subsequent vote on the legislation and if it receives a 2/3rd majority it shall become law.
Article II: The Executive Government
2.1 All executive authority in the Commonwealth shall be invested in a Commonwealth Executive styled as the "Cabinet of the Commonwealth" consisting of the President of the Commonwealth and Cabinet Secretaries.
2.2 Every general election, there shall be an election for the President of the Commonwealth. The citizen with the most number of votes shall be elected President of the Commonwealth of Mazeria.
2.3 The President shall have the authority to nominate all Cabinet Secretaries and appoint all Cabinet Officers, who shall serve at the Pleasure of the President or until such a time as they are removed from Office as provided in this Constitution or pursuant to any other Act of Congress.
2.4 Cabinet Secretaries, once nominated, shall appear before the Senate of the Commonwealth for confirmation. Should the Senate veto the nomination, the President must nominate a different individual for that Cabinet post. The vetoed nominee may be renominated after a period of no less than 1 week. This may be overturned by a Congressional Resolution.
2.5 In the event of the resignation or impeachment of the President, the next person in the presidential line of succession will take office as the acting President of the Commonwealth until the end of the term. The President may add to the line of succession after the first 2 members set out in this constitution:
(1) The President of the Senate
(2) The Speaker of the House of Representatives
2.6 The President, Cabinet Secretaries and Cabinet Officers may be impeached by the Senate if they have:
(a) Committed Treason, Sedition or any other Acts of High Crime as described by this Constitution or further Acts,
(b) Lost citizenship.
Article III: The Judicial Government
3.1 All judicial authority in the Commonwealth shall be invested in a Commonwealth Judiciary styled as the "Supreme Court of Mazeria" consisting of Associate Justices. The Supreme Court shall have jurisdiction over all citizens of the Commonwealth of Mazeria and persons acting within the territories of the Commonwealth.
3.2 Associate Justices shall be elected every 3 months during a General Election. Justices, from amongst themselves, will elect a presiding officer to be styled as the "Chief Justice". The Supreme Court may establish its own procedures and regulations to aid in the completion of its duties.
3.3 The Supreme Court shall have authority over all cases and controversies arising under:
(a) The Constitution,
(b) Laws of the Commonwealth,
(c) Treaties of the which the Commonwealth is involved,
3.4 The Chief Justice and Associate Justices may be impeached by the Senate for:
(a) Losing Citizenship
Article IV: General Elections
4.1 General Elections shall occur every 60 days and shall be organised by the Electoral Commissioner
4.2 The Electoral Commissioner shall be a designated member of the Administrative team of the Proboards forums of Mazeria.
4.3 To be eligible for any position up for election in a General Election, an individual must:
(a) be a citizen of the Commonwealth of Mazeria
(b) be eligible via any other regulations regarding the position set by this Constitution or Acts of Congress
4.4 Victors of elections shall be determined by a first past the post system where only citizens of the Commonwealth may vote.
Article V: Ratification, Amendments, Supremacy
5.1 The Congress of the Commonwealth, by a majority two-thirds vote, shall have the power to present Amendments of this Constitution to the Citizens of the Commonwealth. No amendment shall be ratified as part of the Constitution unless it is voted in favour, by a simple majority vote, by the citizens of the commonwealth in a referendum held at the next general election, or any other date decided by the Congress. Upon ratification by the citizens in a referendum, the President shall sign the amendment into law. The President may not veto the amendment.
5.2 This Constitution of the Commonwealth of Mazeria shall be the supreme law of the region. Any further legislation created after the ratification of this Constitution which contradicts this constitution, shall be considered null and void.
5.3 This Constitution of the Commonwealth of Mazeria shall be ratified upon a vote in favour of this constitution by a simple majority of citizens.
